SENATE BILL NO. 86                                                                                                            
                                                                                                                                
     "An  Act  relating to  the  protection  of property  of                                                                    
     persons under  disability and  minors; relating  to the                                                                    
     crime  of  violating   a  protective  order  concerning                                                                    
     certain  vulnerable  persons; relating  to  aggravating                                                                    
     factors at sentencing for  offenses concerning a victim                                                                    
     65  years  or  older;  relating to  the  protection  of                                                                    
     vulnerable  adults; amending  Rule 12(h),  Alaska Rules                                                                    
     of  Criminal  Procedure;  amending Rule  45(a),  Alaska                                                                    
     Rules of  Criminal Procedure; amending Rule  65, Alaska                                                                    
     Rules  of Civil  Procedure;  amending  Rule 17,  Alaska                                                                    
     Rules  of Probate  Procedure; amending  Rule 9,  Alaska                                                                    
     Rules   of  Administration;   and   providing  for   an

Co-Chair Stedman shared that  the legislation had previously                                                                    
been heard by the committee.                                                                                                    
                                                                                                                                
KIMBERLY  POPPE-SMART,  DEPUTY COMMISSIONER,  DEPARTMENT  OF                                                                    
HEALTH  AND   SOCIAL  SERVICES,  explained  that   the  bill                                                                    
provided  additional  protections   to  vulnerable  Alaskans                                                                    
including,   the   opportunity   to  appoint   a   temporary                                                                    
conservator  and  ex  parte   protection  of  financial  and                                                                    
property  interests.  Additionally,  the  legislation  added                                                                    
mandated reporters  in schools and health  care settings and                                                                    
incorporated  the  definition  of "undue  influence"  as  an                                                                    
offence that could be acted upon.                                                                                               
                                                                                                                                
Co-Chair   Stedman  highlighted   seven  new   fiscal  notes                                                                    
including six zero notes from  the Departments of Health and                                                                    
Social  Services (DHSS),  Administration  (DOA), Law  (DOL),                                                                    
Public Safety (DPS), Corrections  (DOC), and Courts; and one                                                                    
fiscal  impact note  from DPS  in the  amount of  $48,000 in                                                                    
general  funds to  cover  costs of  the  development of  new                                                                    
protective order forms, updates  to the Alaska Public Safety                                                                    
Information Network, and training.                                                                                              
                                                                                                                                
Co-Chair  Hoffman  MOVED  to  report  CSSB  86(JUD)  out  of                                                                    
committee   with   individual    recommendations   and   the                                                                    
accompanying fiscal notes. There  being NO OBJECTION, it was                                                                    
so ordered.                                                                                                                     
                                                                                                                                
CSSB 86(JUD) was REPORTED out  of committee with a "do pass"                                                                    
recommendation  and with  six new  zero fiscal  notes: DHSS,                                                                    
DOA, DOL, DPS,  DOC, and Courts; and one  fiscal impact note
